Lawrence v. Palmer, 59 A.D.3d 394 (2d Dept 2009)

Plaintiff’s motion for a default judgment pursuant to CPLR 3215 was denied, and defendant’s request to compel acceptance of their late answer was granted.  The Appellate Division affirmed, noting plaintiff was not prejudiced, and the lower court properly exercised its discretion in finding defendant had a reasonable excuse and potentially meritorious defense.
