In re Janeen Tortora, 72 A.D.3d 1105 (2d Dept 2010)

This action sought to preclude decedent’s father from receiving any distribution of settlement proceeds from a wrongful death and personal injury action.  The Surrogate's Court denied the father’s motion pursuant to CPLR 3124 to compel decedent's mother to provide outstanding discovery, or be precluded pursuant to CPLR 3126 from testifying and/or to strike the petition.  The Appellate Division affirmed, noting the father demands were irrelevant to the issues, including claims by the mother as to lack of support and abandonment pursuant to EPTL 4-1.4 (a) (1).
