Bajada v. Spector, 119 A.D.3d 622 (2d Dept 2014)

Defendant’s motion for summary judgment was denied in this action involving injuries from a motor vehicle and bicyclist accident.  The Appellate Division reversed.

Plaintiff was a 16 year old son bicyclist, when he was involved in an accident with defendant’s vehicle.  At the time, the bicyclist was governed by a stop sign, and defendant was not controlled by any traffic device.  The defendant established entitlement to summary judgment on the issue of liability, showing the plaintiff’s failure to yield the right-of-way was the sole proximate cause of the accident. Defendant was entitled to anticipate that the plaintiff would obey the traffic law.
