Bernard v. Magliore, 304 A.D.2d 781 (2d Dept 2003)

Categories

Plaintiff appealed from a lower court order which denied her motion to reassert severed claims, in the trial of the remaining cause of action in the complaint, which had been severed; her cause of action for physical injuries was dismissed by a judgment of the same court and a subsequent judgment dismissed the remaining causes of action.
The Appellate Division dismissed the appeals. The right to appeal from the intermediate order was terminated with the entry of judgment. The appeal from the judgment was dismissed as abandoned. Plaintiff’s remaining contentions regarding rulings outside of the order appealed from were not properly before the court.
