Richards v. Lewis, 243 A.D.2d 615 (2d Dept 1997)

Defendant moved to dismiss the action as abandoned, pursuant to CPLR 3215, when plaintiff failed to seek a default judgment within 1 year of default. The lower court denied defendant’s motion, and the Appellate Division reversed.
To avoid dismissal as abandoned, plaintiff must offer a reasonable excuse for the delay and the merits of the complaint. While plaintiff provided a sufficient excuse for his delay in seeking a default judgment, plaintiff did not establish the merits of his complaint, as the verification of the complaint was made by plaintiff's attorney and not the plaintiff himself.
