Jung Hee Lee v. Viera, 145 A.D.3d 674 (2d Dept 2016)

Categories  , ,

Defendant was awarded dismissal pursuant to CPLR 3211(a)(5), on the basis of res judicata.  The Appellate Division affirmed.

Due to plaintiff's repeated failure to comply with court-ordered discovery, a conditional order of preclusion was issued.  Plaintiff again failed to comply, and defendant moved for summary judgment which was granted.  The court held plaintiff's failure to appear for deposition as ordered, precluded plaintiff from establishing a prima facie case of liability against defendant.

Plaintiff appealed, but never perfected and subsequently withdrew the appeal.  Plaintiff subsequently commenced a second action against the defendant, based on the same facts and seeking the same relief.  The Supreme Court granted defendant's motion to dismiss as it was barred by res judicata.

“A dismissal is on the merits where a plaintiff attempts “to circumvent an order of preclusion or summary judgment, the function of which is to effectively foreclose [the] proponent's offer of proof”… Contrary to the plaintiff's contention, the order in the prior action granting the defendant's motion for summary judgment dismissing the complaint was on the merits.
